Swimming and Drowning Injuries

According to the Centers for Disease Control, in 2005, an average of ten people a day died in the United States from drowning. Drowning remains the second leading cause of unintentional injury related death for children ages 1-14 and the number one cause of accidental deaths for children ages 1-5. Here in Texas, about 60 children every year drown or almost drown.

Not only are children at risk, adults die in swimming, drowning, and boating accidents as well. Texas has numerous waterways, rivers, lakes, the Gulf, and private and public swimming pools – all of which have their risks. If you’ve lost a loved or have suffered injuries due to a drowning, near drowning, or swimming accident, you may have legal options.

Unsafe conditions and negligence are often contributing factors in drowning. In addition, the failure to secure a pool may also be cause for pursuing legal actions. If the drowning occurred as the result of an accident with a boat or jet ski, further factors could have contributed to the death or swimming injury including alcohol, negligence, and product defects.

A survivor of a near drowning often faces long, difficult recoveries and costly medical care. The CDC reports that a nonfatal drowning can cause brain damage that may result in long-term disabilities. Among these long term disabilities are learning disabilities, memory problems, and a permanent loss of basic functioning such as the victim being in a permanent vegetative state.

Those who do not survive will have significant costs including emergency services, medical care, funeral costs, and, if the victim was the head of a household, permanent loss of income and related damages.
